Capturalab (“we,” “us,” or “our”) is a U.S.-based Concept Design Visualization Studio that creates high-quality visuals (images, videos, animations) for clients worldwide.   • Account Credentials: Username and password that you create for our webapp.
  • Project Information: Details you provide about your project requirements or preferences, and any materials you upload (e.g. project briefings, reference images, design specifications, contracts or NDAs).
  • Communications: Correspondence you send us, including emails or messages through the webapp (for example, project instructions or feedback).

We do not collect sensitive financial information on our site. Capturalab does not collect or process payment data (such as credit card numbers or banking details) through the website or webapp at this time. Any payment for services is handled separately/offline, so no payment information is entered or stored in our online Services.

Information We Collect Automatically

When you visit our site or use the webapp, we automatically collect certain technical and usage information:

  • Usage Data: Details of how you use our Services, such as the pages or screens you view, the features you use (e.g. our proofing interface), and the time spent on each page.

Capturalab uses the collected information for the following purposes:

  • To Provide Services: We process your personal data to create and manage your user account, authenticate you when you log in, and allow you to manage projects, upload/download materials, and use our proofing interface. We also use your information to produce and deliver the visual content you request from us.
  • To Communicate: We use contact information (like email) to send you service-related communications. This includes project updates, information about drafts and checkpoints, responses to your inquiries, and notifications about changes or issues (such as platform maintenance or updates). If you have opted in to marketing communications, we may send occasional news about Capturalab services or new features, but you can opt out at any time.
  • To Facilitate Feedback and Collaboration: The information and files you upload, as well as your comments in the proofing interface, are used to collaborate on the project. Our team will review your inputs to refine the visuals per your feedback.
  • To Improve and Analyze Services: We use usage data and analytics to understand how our platform is used and to improve the user experience, troubleshoot technical issues, and develop new features. For example, analyzing which features are most used helps us prioritize updates.
  • For Security and Fraud Prevention: We may use data (especially logs and IP addresses) to monitor for suspicious activity, protect against unauthorized access, enforce our Terms of Use, and prevent fraud or abuse of our Services.
  • To Comply with Legal Obligations: In certain cases, we need to process personal information to comply with laws or regulations (such as responding to lawful requests by public authorities or keeping required business records).
  • Future Uses with Consent: If we intend to process your personal data for a purpose that requires consent (for example, using your information in a testimonial on our site), we will obtain your consent. You have the right to withdraw consent at any time.

We understand the importance of keeping your personal information private. We do not sell your personal data to third parties. We only share information in the following circumstances:

  • Service Providers and Partners: We use trusted third-party companies to help us operate and provide our Services (“processors”). This includes cloud hosting providers (to store files and data securely), analytics and tracking providers (such as Google Analytics), customer relationship management or communication tools (for example, an email service to send notifications), and any feedback or project management tools integrated into our webapp. These service providers process personal data on our behalf and are contractually obligated to safeguard it and only use it for the purposes we specify.
  • Business Transfers: If Capturalab is involved in a merger, acquisition, financing due diligence, reorganization, bankruptcy, receivership, sale of company assets, or transition of service to another provider, your information may be transferred as part of that transaction. We will ensure the acquiring party is bound to respect your personal data in a manner consistent with this Privacy Policy.

  • With Your Consent: In situations where you explicitly consent to sharing (for example, if you ask us to collaborate with a partner agency or you authorize sharing a case study of your project on our portfolio), we will share your information only as instructed.
  • Team Members or Collaborators: If you are using our Services as part of a team or organization (for instance, multiple people from your company are involved in a project), some of your information (like your name, project contributions, and comments) will be visible to other authorized users on the same project. This is inherent to how the collaboration features work.

When we share data with third parties, we only provide the minimum necessary information for them to carry out their duties.

Third-Party Tools and Services

Capturalab relies on a number of third-party tools and services to operate our website and webapp effectively. These third parties may collect or have access to certain personal data as part of their services. We choose reputable providers and strive to ensure they protect your information. Key third-party integrations include:

  • Analytics: As noted, we use analytics tools like Google Analytics. Google Analytics uses cookies and similar tech to collect data about website usage and provides us reports. Although Google Analytics records things like your IP address, Google provides options to anonymize IPs. You can opt-out of Google Analytics by using a browser add-on if you wish. (See Google’s Privacy Policy for details on their data practices.)
  • Tracking/Advertising: We use Google Tag Manager to manage scripts and may use a Facebook Pixel on our site. These tools help us understand the effectiveness of our site content and marketing. Facebook Pixel, for example, can inform us if a user visited our site after seeing an ad on Facebook. The information collected via such pixels may be used by the third-party (like Facebook) for their own advertising purposes according to their privacy policies.
  • Cloud Storage and Hosting: Our webapp and file uploads are hosted on third-party cloud servers (for example, AWS or similar cloud infrastructure). These servers store your project files and data. We implement access controls and encryption to protect data stored in the cloud.
  • Project Collaboration Tools: Our proofing and feedback interface is developed by Capturalab, but we may use third-party libraries or frameworks within it. In the future, we might integrate external services (for example, a plugin for project tracking or a chat support widget). If any such integration collects personal data or uses cookies, we will update our Privacy Policy to reflect that.
  • Social Media and Video Platforms: Our website may include features that link to social media (e.g., Instagram, LinkedIn) or display content hosted on third-party platforms (e.g., a Vimeo or YouTube video of our showreel). If you interact with these features, those third parties may collect some data (such as which page you visited and that you clicked a social media icon) under their own privacy policies.

We encourage you to review the privacy policies of any third-party services you interact with via our site. However, note that we do not share your personal contact information with social media platforms or other third parties without your consent, aside from the tracking/analytics uses described above.

Data Retention

We retain personal data only for as long as necessary to fulfill the purposes outlined in this Privacy Policy, unless a longer retention period is required or permitted by law. In general:

  • Account Information: If you have an account with Capturalab, we retain your personal information while your account is active. If you decide to close your account or if it has been inactive for a long period, we will delete or anonymize your personal information from our active databases, except to the extent we need to retain it for legal or administrative purposes (such as record-keeping, fraud prevention, or resolving disputes).
  • Project Materials: Files and documents you upload for projects may be retained for the duration of the project and for a period after project completion. We may keep project data to support the services we provide to you (for example, if you come back for revisions or future projects) and to maintain a record of our work. If you need us to delete specific project files after completion, you can request this.
  • Communications: Emails and communications with you may be retained for documentation and to improve our customer service, as well as to establish a history of your interactions with us.
  • Analytics Data: We may retain aggregated analytics data (which does not directly identify individuals) indefinitely to help us understand long-term usage trends.

When we have no ongoing legitimate business need to process your personal data, we will delete it or anonymize it. If deletion or anonymization is not immediately possible (for example, because the data is stored in backup archives), we will securely store it and isolate it from further processing until deletion is possible.

Your Rights and Choices

You have certain rights and choices regarding your personal information. Capturalab is committed to honoring these rights.

Access, Correction, and Deletion

You may contact us at any time to:

  • Access/Request a Copy: Ask for a copy of the personal data we hold about you, or request information about how we have used it.
  • Correction: Request that we correct or update any inaccurate or incomplete personal data.
  • Deletion: Request that we delete your personal data. If you wish to close your account or remove personal information, contact us and we will take reasonable steps to honor your request. (Note: we may need to retain certain information for legal reasons or legitimate business purposes as described in the Data Retention section.)

Privacy Choices

  • Marketing Opt-Out: If we send marketing or promotional emails, you can opt out by clicking the “unsubscribe” link in those emails or by contacting us. Note that you will still receive transactional and service-related communications (e.g., project updates or administrative notices).
  • Cookie Preferences: You can manage cookie preferences through your browser settings. Some browsers and devices also support “Do Not Track” (DNT) signals; while our site does not currently respond to DNT signals, you can typically limit tracking by adjusting cookie settings as mentioned.
  • Account Settings: In our webapp, you may have profile settings to update certain information. Please keep your contact information up to date.

Rights of Individuals in the European Economic Area (EEA), United Kingdom, and other GDPR Regions

If you are in the EEA, UK, or a jurisdiction with similar laws, you have the following additional rights regarding your personal data:

  • Right to Withdraw Consent: If we process your data based on consent, you can withdraw that consent at any time (this will not affect the lawfulness of processing based on consent before its withdrawal).
  • Right to Object: You can object to our processing of your data in certain situations, in particular to direct marketing or when we process data based on legitimate interests.
  • Right to Restrict Processing: You can ask us to restrict or suspend processing of your personal information under certain circumstances (for example, if you contest the accuracy of the data, or you want to preserve data for a legal claim).
  • Right to Data Portability: You can request a copy of your data in a commonly used machine-readable format, and you have the right to transmit that data to another controller where applicable (for data you provided and which we process by automated means based on consent or contract).
  • Right to Complain: If you believe our handling of your personal data violates the law, you have the right to lodge a complaint with your local data protection supervisory authority. We would, however, appreciate the chance to address your concerns directly before you do so, and you can contact us with any issues.

Rights of California Residents (CCPA/CPRA)

If you are a California resident, you have specific rights under the California Consumer Privacy Act (CCPA) as amended by the CPRA:

  • Right to Know: You can request that we disclose what personal information we collect, use, disclose, and sell (note: Capturalab does not sell personal information). You may request the specific pieces of personal information we have collected about you, as well as the categories of sources, purposes for collecting, and third parties with whom we share information.
  • Right to Delete: You can request that we delete personal information we have collected from you (with certain exceptions, such as if the information is necessary to complete a transaction, detect security incidents, comply with legal obligations, etc.).
  • Right to Opt-Out of Sale/Sharing: You have the right to opt out of the sale of your personal information. As noted, we do not sell your data. If in the future we consider selling data (which we do not currently do), we will provide a clear “Do Not Sell My Personal Information” link. Also, if we engage in sharing your data for cross-context behavioral advertising (as defined by CPRA), you can opt out of that as well.
  • Right to Non-Discrimination: We will not discriminate against you for exercising any of your CCPA rights. This means we won’t deny services, charge different prices, or provide a different level of quality just because you exercised your rights (except as permitted by law, for example offering a financial incentive that you can opt into in exchange for certain data, but we have no such program at this time).

We may need to verify your identity (for example, by confirming information we have on file) before fulfilling certain requests, especially for access or deletion in California. If you have an authorized agent making a request on your behalf, we may require proof of the agent’s authority and your verification that the agent’s request is legitimate.

International Data Transfers

Capturalab is headquartered in the United States, and the information we collect from you will be processed in the U.S. and possibly in other countries (for example, where our third-party service providers operate or have servers). These countries may have data protection laws that are different from those in your country of residence, and in some cases, may not be as protective.

However, we take steps to ensure that your personal data is handled securely and in accordance with this Privacy Policy and applicable law. If you are located outside the U.S., we rely on legally-provided mechanisms to transfer data across borders, such as:

  • Contractual Protections: For example, for data coming from the EEA or UK, we may use standard contractual clauses (SCCs) approved by the European Commission, which contractually oblige the recipient to protect your personal data.

You also play a role in protection: please keep your account credentials confidential and notify us immediately if you suspect any unauthorized access to your account. In the event of a data breach that affects your personal information, we will notify you and the appropriate authorities as required by law.

Children’s Privacy

Our Services are intended for business and professional use by adults. We do not direct our website or webapp to children under 18, nor do we knowingly collect personal information from anyone under 13 years of age. If you are under 18, please do not use or register on our site or provide any personal information to us.
